Terms of Use
These Terms of Use (hereinafter referred to as "these Terms") define the conditions for using the band member matching service "BandSync" (hereinafter referred to as "this Service") provided by the operator of BandSync (hereinafter referred to as "the operator"). All registered users (hereinafter referred to as "users") shall use this Service in accordance with these Terms.
Article 1 (Application)
- These Terms shall apply to all relationships between users and the operator concerning the use of this Service.
- Regarding this Service, in addition to these Terms, the operator may establish various rules and regulations for use (hereinafter referred to as "Individual Provisions"). Regardless of their names, these Individual Provisions shall constitute a part of these Terms.
- If the provisions of these Terms contradict the provisions of the Individual Provisions in the preceding paragraph, the provisions of the Individual Provisions shall take precedence unless otherwise specified in the Individual Provisions.
Article 2 (User Registration)
- In this Service, registration shall be completed when a person wishing to register agrees to these Terms, applies for registration by the method specified by the operator, and the operator approves this.
- If the operator determines that any of the following reasons apply to the applicant for registration, the operator may not approve the application for registration and shall not be obliged to disclose the reason:
- When false information is provided at the time of application for registration
- When the application is from a person who has violated these Terms in the past
- In any other cases where the operator deems the registration to be inappropriate
Article 3 (Purpose of this Service and Use Restrictions)
⚠️ IMPORTANT: This service is a matching service for musical activities
- This Service is for member recruitment and search for musical activities and band activities.
- Using this Service for the purpose of meeting someone for dating or sexual relationships is strictly prohibited.
- Users shall use this Service only for the purpose of finding partners for music activities. If use for the purpose of dating is discovered, the operator may suspend or delete the account without prior notice.
- This Service does not fall under the category of "Internet Heterosexual Introduction Business" as defined in the "Act on Regulation on Soliciting Children by Using Internet Heterosexual Introduction Business, etc." (Dating Site Regulation Act).
Article 4 (Prohibited Acts)
Users must not perform the following acts when using this Service:
- Acts that violate laws and regulations or public order and morals
- Acts related to criminal behavior
- Use for the purpose of dating
- Acts related to compensated dating, prostitution, or solicitation thereof
- Acts related to sexual services
- Inappropriate contact or solicitation of persons under the age of 18
- Acts that infringe on the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the operator or a third party
- Acts that may interfere with the operation of this Service
- Unauthorized access or attempts thereof
- Collecting or accumulating personal information of other users
- Using this Service for an improper purpose
- Acts that cause disadvantage, damage, or discomfort to other users or other third parties
- Impersonating other users
- Promotion, advertising, solicitation, or business activities on this Service not permitted by the operator
- Acts for the purpose of meeting strangers of the opposite sex
- Profit-offering or other cooperation with anti-social forces
- Solicitation for religious activities or religious organizations
- Other acts that the operator deems inappropriate
Article 5 (User-Generated Content)
- Users shall guarantee that the content they post on this Service (recruitment articles, comments, profile information, etc.) is legal and appropriate.
- The operator may monitor the content posted by users and may delete content deemed inappropriate without notice.
- Users can report inappropriate acts of other users to the operator. The operator will strive to respond within 24 hours of receiving a report.
- Users can use the function to block other users.
Article 6 (Paid Services)
- This Service includes paid functions (BandSync Pro, Boost function, etc.).
- The fees for paid services shall follow the fee schedule posted on this Service or the operator's website.
- When users use paid services, they shall pay the fees by the method specified by the operator.
- Subscription purchases from the iOS app are processed via the App Store in accordance with the terms of Apple Inc.
- Fees already paid will not be refunded except as provided by law.
Article 7 (Changes and Suspension of Service Content)
- The operator may change the contents of this Service or stop its provision without prior notice to users, and shall not be liable for any damage caused to users as a result.
Article 8 (Restriction of Use and Deletion of Registration)
- 1. The operator may restrict the use of all or part of this Service or delete the user's registration without prior notice if the user falls under any of the following:
- Violation of any provision of these Terms
- When it is discovered that there is a false fact in the registered information
- In any other cases where the operator deems the use of this Service to be inappropriate
- 2. The operator shall not be liable for any damage caused to the user by the operator's acts based on this Article.
Article 9 (Disclaimer)
- The operator's liability for default shall be exempted unless it is due to the operator's intentional or gross negligence.
- The operator is not responsible for any transactions, communication, or disputes arising between users or between users and third parties regarding this Service.
- The operator shall not be liable for the results of musical activities or band activities performed by users through this Service.
Article 10 (Changes to the Terms)
- The operator may change these Terms at any time without notice if deemed necessary.
- The revised Terms shall take effect from the time they are posted on the operator's website.
Article 11 (Governing Law and Jurisdiction)
- Japanese law shall be the governing law for the interpretation of these Terms.
- In the event of a dispute regarding this Service, the court having jurisdiction over the location of the operator's head office shall be the exclusive agreement jurisdictional court.
